Terms of use

Simple rules for a simple tool. By using ventaya.co you accept these terms.

This is an English translation for convenience. The Spanish version governs if the two ever differ.

1. What Venta Ya is and who runs it

Venta Ya is an editor that generates product catalogs with WhatsApp order buttons, plus an optional service to host those catalogs at a web address. It's operated by Scout Theory LLC from Medellín, Colombia. Contact: WhatsApp +1 614 607 1230.

2. Free plan

You can use the editor without signing up, at no cost and with no time limit. The free plan allows up to 40 products per catalog, and the generated file includes a line at the bottom saying it was made with Venta Ya. You're never charged anything for the free plan.

3. The catalog is yours

The content you put in your catalog (names, prices, photos, text) is yours and stays yours. We claim no rights to it. You're responsible for having permission to use the photos, brands and text you include, and for your prices and information being accurate.

4. Hosted plan

The hosted plan publishes your catalog at its own web address for a one-time payment of $99,000 COP. There are no monthly fees or recurring charges. It includes: a permanent web address, the ability to update the catalog as often as you want, a QR code that opens the catalog, basic stats (visits and taps on “Order”), no 40-product limit, and no “Made with Venta Ya” line.

The catalog is published once payment is confirmed and it passes the review in section 6, usually the same day. We publish the catalog from the data you send us, using our own template; we don't publish files or code sent by users.

You'll receive an edit link. That link works like a password: whoever has it can change your catalog. Don't share it or paste it in chats with customers. If you think someone else has it, ask us for a new one on WhatsApp and the old one stops working.

Technical limits of the hosted plan: up to 200 products and up to 12 MB of photos per catalog.

5. Prohibited content

You may not use Venta Ya, on either the free or the hosted plan, to offer or promote:

  • Controlled or illegal substances, or items for their use or production.
  • Firearms, ammunition, explosives or prohibited weapons.
  • Sexual services or explicit sexual content.
  • Prescription medication without legal authorization to sell it.
  • Counterfeit products, or products that infringe trademarks or copyrights.
  • Gambling or games of chance without a Coljuegos license.
  • Stolen goods, fake documents, or other people's personal data.
  • Any other good or service that's illegal to sell in Colombia.

You also may not put a WhatsApp number in a catalog that doesn't belong to you or that you aren't authorized to use, or use a web address that impersonates another company, organization or person.

You may sell, among other things, alcoholic beverages, CBD products that are legal in Colombia, tobacco and vaping products in compliance with advertising and age restrictions, and adult items, always within the law.

6. Review, reports and removal

On the free plan we don't see your catalog: it's made in your browser. The prohibitions in section 5 still apply, and you alone are responsible for what you distribute.

On the hosted plan, before publishing a catalog we review it, partly automatically and partly by a person, to check that it complies with section 5. If something needs manual review, we'll tell you: “We're reviewing your catalog. We'll message you within 24 hours.” Catalogs that don't need review are published immediately.

Every hosted catalog has a Report link. If we receive a report, we may unpublish the catalog while we review it, and we reply to the owner within 48 hours.

If a hosted catalog violates section 5, we remove it without a refund. If the violation is serious or repeated, we may refuse to publish future catalogs from the same person or number.

7. Refunds

If you paid for the hosted plan and your catalog was never published (for example, because it didn't pass review or because you changed your mind before publication), we'll refund the full payment if you ask within 5 business days of paying. Once the catalog is published, the payment isn't refundable, unless the failure is ours and we can't fix it.

8. Personal data

What we store, why, and for how long is in our privacy policy, which is part of these terms. In short: on the free plan we store nothing from the editor; on the hosted plan, your WhatsApp number, the catalog's name and content, and two visit counters. We never see your customers.

9. Availability and warranties

The editor is provided “as is.” We do our best to make it work in current browsers and to keep hosted catalogs available, but we don't guarantee permanent availability or compatibility with every device. We're not responsible for lost orders, price errors you typed, or changes to WhatsApp that affect the links.

If we stop operating the hosted plan, we'll tell you on WhatsApp at least 60 days in advance and give you your catalog as a file so you can keep using it.

10. Inactivity

A hosted catalog that goes 24 months without edits or visits may be deleted. We'll message you on WhatsApp first and wait 30 days for your reply.

11. What you can't do with the tool

  • Remove the “Made with Venta Ya” line from a free-plan catalog. The hosted plan removes it.
  • Copy the editor to offer it as your own service.
  • Try to access someone else's catalog or edit link.

12. Changes

We may update these terms. The date below shows the version in force. Changes that affect the hosted plan are announced on WhatsApp to everyone who has it.

13. Governing law

These terms are governed by the laws of the Republic of Colombia, including the Consumer Statute (Ley 1480 de 2011). We'll try to resolve any disagreement by talking it through on WhatsApp first. As a consumer, you can also go to the Superintendencia de Industria y Comercio.
